I've been handling medical negligence cases in North Carolina, since the early 80s. What's important is that there's a distinction between a bad result, something you didn't expect to happen, and something that happens due to negligence. Not every bad medical result is the result of negligence. One of the first things we have to explain to our clients is that in North Carolina, before you can bring a medical negligence action and file it in the courthouse, you have to obtain the medical records. Those medical records have to be reviewed by a qualified expert, who says that the standard of care was not met, and that he is willing to testify.
Until that occurs, you cannot file a case in this state. People who come to me with medical negligence cases often are enduring the very worst period of their lives. They need compassion, they need experience, they need intelligence, they need integrity to try to resolve what is going on, and try to help them with their future.
