    A 2-year-old suffered a closed head injury resulting in attention deficit disorder and hyperactivity when the vehicle in which he was a rear -seat passenger was struck from the rear by the defendant -owned dump truck. The plaintiff contended that the driver of the truck failed to keep an assured clear distance and failed to maintain control of his vehicle. The defendant denied liability, but settled with the plaintiff for $1,000,000.
